GROUP I — FREE USE: School or District-sponsored groups/activities
Free use of facilities will be granted to District-sponsored groups for meetings and activities designed to exchange ideas, educate, and involve parents, students and community participation in school district events. Examples of groups with free status are school sponsored clubs, Boy Scouts, PTA, Booster Clubs, education foundation, district employee groups. Free use is limited to a meeting place. A charge to non-district users may be made for use of equipment, custodial services, Food Service personnel.
GROUP II — PUBLIC AGENCIES/COMMUNITY BASED ORGANIZATIONS:
Government bodies and their subdivisions shall qualify for the Group II rate. Federal, state, county, city, special district, and service areas constitute public agencies. Examples of Community based organizations, non-profit organizations, homeowners associations, charitable organizations, religious organizations, service clubs, community leisure groups, etc.
GROUP III — COMMERCIAL USE:
Group III category shall consist of businesses, for profit organizations, utilities, corporations, companies, etc_ Users in Groups I and II who charge fees or solicit contributions which are not expended directly for the welfare of the pupils of the district or for charitable purposes will be charged the Group Ill rate.
GROUP IV — ATHLETIC LEAGUES:
Youth sports organizations who use school fields and facilities on a continuous basis for sign-ups, tryouts, practices, league games, and post season championships are considered in the Group IV classification.
GENERAL CONDITIONS:
District facilities may be made available for use when school custodial or supervisory personnel are on duty. At other times, school facilities may be deemed available for use if the user pays to the district the employee compensation cost for the district employee assigned to monitor the facility during the use period. This payment shall be in addition to the facilities use rental charge specified in the Facilities Use Fee Schedule.
CUSTODIAL OVERTIME CHARGES (2 hour minimum):
In addition, use during weekend, holiday or evening hours requires custodial overtime. All groups will be responsible for custodial overtime charges based on current year salary rates which may range from $22.00 to $31.00 per hour or more. Overtime charges will be assessed for a minimum of 2 hours. If overtime is necessitated by a non-district facility user who fails to leave the facility at the scheduled time, an additional charge of custodial time will be assessed as follows: For the first 15 minutes or portion thereof, one and one-half times the custodian's rate of pay. For each additional 15 minutes or portion thereof a charge of an additional hour of pay at the overtime rate will be assessed.
FOOD SERVICE WORKERS/OTHER DISTRICT STAFF CHARGES:
Food Service worker charges and charges for use of kitchen facilities will be billed at a rate determined by the Food Services Department. Charges for services of other district staff will be determined and billed based on individual staff member assignments.
SUPERVISION REQUIREMENTS:
District: The principal or administrator in charge of the school site or district facility has full responsibility for supervision and management of all property of that school at all times. Upon receipt of notice that a permit has been approved and issued to a non-school agency, the principal/administrator in charge shall designate a regular employee to open the building, to be in charge of the building during the use, and to close the building after the use if the usage occurs during regular working hours of district employees. If use is during non-working hours, the lessor must pay for any employee to perform these services.
Facility User: Sponsor requesting use of facilities must accept complete responsibility for the conduct of those attending, care of property, and payment of rental. Where minors are involved, organizations seeking use of school premises must have sufficient adult supervision to insure adequate control. Adult sponsor must be present before facilities will be opened. All adult supervisors/sponsors must be over 21 years of age.
The undersigned agrees to defend, indemnify and hold harmless the WALNUT CREEK SCHOOL DISTRICT, its Governing Board, officers, agents and employees, individually and collectively, from and against all costs, losses, claims, demands, suits, actions, payments and judgments, including legal and attorney fees, arising from personal or bodily injuries, property damage or otherwise, regardless of and however caused, brought or recovered against any of the above that may arise for any reason from or during or be alleged to be caused by the undersigned's use or occupancy of District's facilities, furniture or equipment. The undersigned further agrees to provide a Certificate of Insurance naming the Walnut Creek School District as an additional insured for liability coverages and limits satisfactory to the District.
· Use of public address systems will not be allowed at any time.
· Fields and playing areas must be cleaned of debris ( paper, bottles, cans, etc.) after each usage.
· Portable toilets will be provided and serviced by the applicant; restroom facilities will not be provided by the District. The applicant will place portable facilities in a location approved by the site principal.
· The use of ALL tobacco products in or on school district property is prohibited.
· If there has been rain within 48 hours of the scheduled use, the fields may be too wet or muddy. If the field is wet, whether closed or not, do not use it. Signs are usually posted when the fields are not playable. If the field is posted "closed" do not use it.
· Walnut Creek School District generally follows the rain policy of the City of Walnut Creek. The City's rain hotline is 925/256-3574.
· Parking is allowed in the open parking lots only. No vehicles are allowed on the fields or running tracks at any time.
