Morgan Hill Unified School District Use of School Facilities
At least one week prior to the first use of District facilities, the applying organization shall provide the District with a copy of the additional insured endorsement and certificate of insurance that names the District, its board members, officers, employees, agents, consultants, contractors, representatives and successors to and assignees as additional insureds with respect to claims and liabilities arising out of the insured’s and any of its attendees’ use and/or occupancy of District property and any areas providing ingress and egress to the District property, the condition of District property being used and any areas providing ingress and egress to the District property being used and parking areas.
The undersigned, on behalf of the applying organization, further agrees to obtain and keep in force during the term of the applying organization’s use of District property, a policy of comprehensive general liability insurance with a limit of liability of at least $1,000,000 per occurrence, $2,000,000 annual aggregate. The liability policy must include an additional ensured endorsement insuring the District, its board members, officers, employees, agents, consultants, contractors, representatives and successors to and assignees against claims and liabilities arising out of the applying organization and any of its attendees’ use and/or occupancy of District property and any areas providing ingress and egress to the District property, the condition of District property being used and any areas providing ingress and egress to the District property being used and parking areas. HOLD HARMLESS AGREEMENT
The undersigned, on behalf of the applying organization, agrees to defend, indemnify and hold harmless the District, its Board, Board Members, Officers, Agents and Employees, individually and collectively from and against all costs, losses, claims, demands, suits, actions, payments and judgments arising from personal or bodily injuries, property damage or otherwise, however caused, brought or recovered against any of the above that may arise out of the applying organization and any of its attendees’ use and/or occupancy of District property, including any areas providing ingress and egress to the District property being used and parking areas.
The undersigned states that, to the best of his/her knowledge, the school property for use of which applications is hereby made will not be used for the commission of any act intended to further any program or movement the purpose of which is to accomplish the overthrow of the government of the United States by force, violence or other unlawful means, and that the organization on who behalf he/she is making application for use school property, does not, to the best of his/her knowledge, advocate the overflow of the government of the Unites States or of the State of California by force, violence, or other unlawful means, and that, to the best of his/her knowledge, it is not a Communist action organization or Communist front organization required by law to be registered with the Attorney General of the United States. This statement is made under the penalties of perjury.
The undersigned states, to the best of his/her knowledge, the information entered on this application is accurate. Further, the undersigned agrees to the terms and conditions of this application, District Policy #1610 and all other applicable policies, rules and regulations.
