1. District furniture, seating, equipment, and apparatus are not to be altered, removed, or displaced by any person or group as applicable for the type of District facility used. 2. Organizations/facility users (collectively “Facility User”) are required to name the District as an additional insured by a separate endorsement to the Facility User group’s liability policy for bodily injury, liability, and property damage in the following amounts: one million dollars ($1,000,000) per occurrence and at least one million dollars ($1,000,000) in the aggregate. The District reserves the right to modify this requirement depending on the proposed use. 3. The Representative Agent for the Facility User as identified on the Application for the Use of Facilities must present the District with appropriate evidence of the agent’s authority to make the application. The Representative Agent must also be present for the entire reservation and acknowledges that the Facility User is required to accept full financial responsibility for damage and/or missing property. Facility User is responsible for informing all of its guests about District Rules and Regulations. If a theater or auditorium use is proposed, the Representative Agent shall provide identification and/or complete lists of all persons allowed in the backstage area. This list is to be provided at load-in time and must be approved by supervising District Management. District Management reserves the right to restrict admission of any person to the backstage area. 4. Facilities will not be opened earlier than the “Time In” indicated for each date of use on the Application for the Use of Facilities. Facilities will be closed at the “Time Out” indicated for each date of use on the Application for the Use of Facilities. The times entered on the Application for the Use of Facilities must include the entire time the facility is in use, including, as applicable,: load-in, rehearsals, sound checks, performances, tear down and load-out. If the actual time out on the event date exceeds the “Time Out” indicated on the Application for the Use of Facilities then an hourly fee for each additional hour of use will be taken out of the security deposit. 5. There shall be no smoking in or on school facilities. There shall be no obscene language, quarreling, fighting, gambling, or use of intoxicants, hallucinatory drugs, or narcotics in or on school facilities. There shall be no food, beverages or gum in classrooms or auditoriums. There shall be no helium balloons brought into auditoriums. Violations shall be sufficient cause for denying further use. 6. No live animals are to be brought into District facilities and/or District grounds without the express prior written authorization of District Theater Operations Specialist or District Management. 7. The Facility User using the facilities shall pay for any breakage, damage, or loss of District property, beyond reasonable wear and tear, or any facilities left littered or unsanitary requiring special clean up or repair. A refundable security deposit is due and payable at the time the Application for the Use of Facilities is signed. The actual amount of the deposit is determined by the location and/or size of the facility rented by the Facility User. 8. Any use of school facilities shall comply with all applicable State and local laws and regulations. The Facility User shall insure that all activities held, equipment used and food or other related items of personal property used or distributed; shall comply with applicable State and local fire, health and safety laws and regulations. Any use contrary to law shall be grounds for denial of further use. Parking of vehicles shall comply with all District regulations. 9. Any use by any individual, society, group, or organization for the commission of any act intended to further any program or movement the purpose of which is to accomplish the overthrow of the government of the United States or the State by force, violence, or other unlawful means shall not be permitted or suffered. Any individual, society, group, or organization, which commits any act intended to further any program or movement the purpose of which is to accomplish the overthrow of the government by force, violence, or other unlawful means while using school property, is guilty of a misdemeanor. (Education Code Sections 38135- 38136.) 10. Decorations or signs shall not be placed in any rooms, hallways, lobbies or theaters without the permission of District Management. All approved decorations shall be put up without defacing the building and are subject to supervision by District Management. Any damages incurred by violation of this rule shall be paid for by the party responsible for the damage. NO tape or other adhesives are to be used on the walls of the lobby and theater or on the armrests or backs of the seats in the theater. Please use ribbon or rope to cordon off seating. 11. USE OF AUDITORIUMS. Persons or groups renting District auditoriums are under the direction and supervision of District Theater Operations Specialist. District auditoriums’ staging, set up, load in, and load out are under the direction of District Theater Operations Specialist. All District deliveries and pickups must be pre-arranged with the District Theater Operations Specialist. For theater or auditorium use, the following specific requirements will also apply: a. There shall be no smoke or open flame on stage. Only water-based chemical fog or dry-ice is allowed as a smoke substitute. No other type of smoke producing device will be allowed. Any special effects must be approved by District Theater Operations Specialist prior to the event. b. In compliance with state and city fire codes, all scenery, drapes, props, and other decorative materials on stage must be flame retardant, fire retardant treated, or non-combustible. Certification documents must be available to District Management at load-in. On site flame-proofing tests may be conducted by an inspector from the City of Los Angeles Fire Department. c. ALL technical aspects of a rental production must be pre-approved with the District Theater Operations Specialist prior to the date of the rental event, including, but not limited to microphones, sound equipment, lighting, rehearsal arrangements, and assisted listening equipment. No “last minute” special requests will be honored on the date of a rental production. ONE pre-scheduled APPOINTMENT with the District Theater Operations Specialist is allowed in order to view the theater before booking (NO WALK-INS ALLOWED). Please be sure that all interested parties are present for this meeting. Additionally, ONE pre scheduled WALK-THRU with the District Theater Operations Specialist is required after signing the Application for the Use of Facilities in order to discuss technical needs and concerns (NO WALK INS ALLOWED). Please be sure that all interested parties are present for this meeting. d. NO modifications to the house repertory plots will be made without the prior approval of the District Theater Operations Specialist. NO overhead rigging is allowed without the supervision of an onsite rigger previously approved by the District Theater Operations Specialist. NO stage rigging, stage lighting, or any other stage equipment may be used or changed without the prior approval of District Theater Operations Specialist. e. Advance notice of additional electrical distributions or power drops is required to expedite their availability as needed. f. Person or groups renting school facilities will have access to authorized areas as specified in the Application for the Use of Facilities. Use of lobby, dressing rooms and green rooms is contingent on availability and only by prior approval of District Theater Operations Specialist. g. If Facility User requires the use of a piano, podium, tables, chairs, music stands, follow-spots, choir risers, choir shell, platforms, or the Infrared Hearing System then this must be indicated on the Application for the Use of Facilities and a fee assessed for the equipment and labor required. h. All District theatrical facilities are to be used under the direct supervision of District Management. Supervising District Management reserves the right to shut down production and refuse access to any District facilities if any part of the contract has been breached or any of the Rules and Regulations have been broken by Facility User. i. Crew staffing requirements are to be determined by the District Theater Operations Specialist and additional staffing fees may apply. Custodial Maintenance Staff is mandatory for the first and final hour of each date of use indicated on the Application for the Use of Facilities. Security Staff is mandatory for each performance held in District facilities. The number of personnel required is determined by the District and is based on the specific needs of each individual event. In each case, additional staffing fees may apply. 12. The Facility User shall not obstruct any portion of the sidewalks, entries, halls, stairs, or other egress from or access to the building; nor shall Facility User obstruct access to any or all utilities of the building. Fire code regulations in District facilities shall not be violated under any circumstance. 13. If deemed necessary by the District in its sole discretion, the Facility User shall comply with the requirements of Education Code Section 45125 et seq. with respect to fingerprinting of persons/employees and/or subcontractors who may have contact with District pupils, including if necessary, obtaining certifications from the Department of Justice when requested by the District. 14. The Facility User acknowledges and agrees that the District can suspend or terminate this at any time without excuse or further consideration to the Facility User in the event that the Facility User violates the District’s rules or regulations, or if the Facility User’s actual use is inconsistent with use originally approved by the District. The District also reserves the right to suspend or terminate a use in the event the District determines that the facilities are needed for District purposes. 15. The Facility User, at its sole cost and expense, shall be responsible for supervising its use of the District facilities and shall employ such assistants or additional employees as necessary to supervise such use. The Facility User assumes full and sole responsibility for the actions and/or conduct (negligent or intentional) of such assistants or additional employees, and further agrees to be solely responsible for the payment of all compensation and expenses (including, but not limited to all state and federal withholding and worker's compensation requirements), of said assistants or additional employees. In addition, the Facility User shall be responsible for paying the District any costs incurred by the District for employees or contractors it deems necessary to provide appropriate supervision, assistance, custodial and other services necessitated by the use, in accordance with the District’s Fee Schedule. 16. The Facility User covenants by and for itself, its administrators and all persons claiming under or through it, that the right to use District facilities is made subject to the condition that there shall be no discrimination against or segregation of any person or group of persons, on account of race, color, creed, religion, sex, marital status, national origin, or ancestry, in the use, occupancy or enjoyment of the facilities subject to this application for use. 17. The Facility User shall not voluntarily or by operation of law assign, lease, transfer, mortgage, sublet or otherwise encumber all or any part of Facility User’s right to use District facilities pursuant to this application without obtaining the prior written consent of District in each instance, and any attempt to do so without such consent being first had and obtained shall be wholly void and, at the option of District, shall terminate the Facility User’s right to use District facilities. No attempted subletting or assignment, even with consent of District, shall relieve the Facility User of its obligation to pay the applicable use fee and to perform all of the other obligations to be performed by Facility User under the District’s rules and regulations.
VIOLATIONS OF ANY DISTRICT RULES OR REGULATIONS SHALL BE SUFFICIENT CAUSE FOR DENYING FURTHER USE
