Use of PUSD Facilities
The Board of Trustees of the Pleasanton Unified School District recognizes that school facilities are primarily intended for the education of the children of the District. However, school facilities may be used by residents of the community for the purposes set forth in the California Education Code, provided that such use does not interfere with or restrict the educational program of the District.
Rules and Application
Use of various school facilities shall be granted to responsible organizations and groups within the community, subject to the rules and regulations set forth by the Board of Trustees and the California Education Code. General rules and regulations are stated on the PUSD online request system and must be electronically accepted to submit a schedule request. All requests must be complete and submitted not less than two weeks in advance. Confirmation of Facility User Login, password, and scheduled reservations will be sent via email.
Organizations from outside of the District will be asked to provide proof of liability insurance. A Certificate of Liability Insurance naming "Pleasanton Unified School District 4665 Bernal Ave., Pleasanton, CA 94566" as "Certificate Holder" and as an "Additional Insured" on an Endorsement Statement requires the following insurance coverage: $1,000,000 General Liability, $2,000,000 General Aggregate. The insurance carrier must be admitted in the State of California and have an A.M. Best rating of A-VII or higher.
APPLICATION SHOULD BE SUBMITTED NOT LESS THAN TWO WEEKS IN ADVANCE.
Return the form to the respective principal's office or the Maintenance Office. An approved copy will be mailed to the applicant after the application has been acted upon by the Business Office.
Only recognized community organizations or groups may obtain the use of school premises. All juvenile organizations or groups must have satisfactory adult sponsorship and supervision.
Any person applying for the use of school property on behalf of any society, group or organization shall be a member of such applicant group and, unless he is an officer of such group, must present written authorization from such applicant group to make such application.
All rental charges shall be paid to the District Business Office. All checks shall be made payable to Pleasanton Unified School District. All fees shall be in conformance with the schedule set by the Board of Trustees and shall be subject to change. Said fees for labor or other services shall be included in the rental charge and shall constitute the total charge for use of the facilities. The Boards of Trustees shall set additional fees for facilities as the need arises.
Sections 38130-39 of the California Education Code are the basis for these rules and are hereby incorporated in this application even though not herein duplicated.
Any permit may be revoked without previous notice where conflicting dates have resulted or where need of the property for public school purposes has subsequently developed. For other cause, permits may be revoked at any time upon reasonable notice.
School facilities shall not be available to private teachers for conducting classroom or individual instruction. Reservations may be made by such teachers for public recitals under the terms and conditions set forth for local groups and organizations.
In the case of entertainments or meetings where admission fees are charged or contributions are solicited, and the net receipts of the admission fees or contributions are not expended for the welfare of the pupils of the District or for specific charitable purposes, a charge shall be made for the use of school facilities.
Except as may be limited by Rule 4, the use of all school facilities shall be available without charge to the student body organizations, including the Parent-Teachers' Associations. This privilege is extended to the Boy Scouts, Girl Scouts and other similar youth groups and organizations for meetings of public interest but shall not be used as the established headquarters for such clubs and organizations.
Equipment such as projectors, record players, microphones, etc., will be available for use under these regulations if proper supervisory arrangements have been made.
If free use is granted, as provided in the Civic Center Act, the meeting shall be non-exclusive and shall be open to the public.
Persons or organizations using school premises shall not be permitted to remove or displace furniture or apparatus, nor move pianos on or oft the stage.
Access to rooms or facilities other than approved by application shall not be permitted.
1There shall be no intoxicants or narcotics used in or about school buildings and premises, nor shall profane language, quarreling, fighting or gambling be permitted. Violation of this rule by any organization during occupancy shall be sufficient cause for denying further use of school premises to the organization.
The programs offered in or during the use of any school premises shall at no time contain any matter which might tend to cause a breach of the peace, or which constitutes subversive doctrine or seditious utterance, or which agitates for changes in our form of government or social order by violence or unlawful methods.
No sectarian or denominational doctrine shall be taught or "instruction theron permitted, directly or indirectly in any of the common schools of this state." (California Constitution, Article IX, Section 8)
Juvenile organizations must have acceptable adult sponsorship and supervision which will maintain good discipline and prevent property damage. Failure to conform to this regulation may result in revocation of permission to use school facilities.
No literature shall be advertised or offered for sale on school premises at said meetings.
The use of school premises shall not be granted when, in the opinion of the Board of Trustees, there is a possibility of damage or injury to school property. In the event that loss or damage does occur, the person or group signing the request for use of premises shall be fully responsible and liable and shall assume such liability before being granted the use of the premises.
There shall be no Saturday, Sunday or holiday use of the buildings unless special permission is granted by the Boards. Application for such use MUST be submitted THREE weeks in advance. Such use shall be subject to additional charges for overtime wages of school personnel in charge.
The use of kitchen facilities shall include the assignment of a cafeteria employee to be on duty and in charge of said kitchen, including its equipment and serving facilities.
The use of any school facilities shall include the assignment of a school employee in charge. Said employee shall have charge of the grounds, preserve order and protect the school property.
In executing this application, the undersigned certifies that (s)he is an officer or agent of the group making such application. It is further certified that said group holds harmless the school district for any liability arising out of said use of the facilities requested. The facility user agrees to defend and indemnify the District for any and all claims, however caused.
